December 21, 2017

HG-1729-V Illinois American Water Company (Public Meeting): Consideration of Permit #2017-5132 for a solid fence eight (8) feet in height above grade in the P-1 Governmental Buildings District for 13835 S. Parker Road.

HG-1728-S Enterprise Rent-A-Car (Public Hearing): Consideration of a Special Use for an Automobile Rental Agency in the C-3 General Business District for 13030 W. 159th Street, Homer Glen.

Development Review Fees: Staff will be presenting suggested changes to fees relating to annexations, zoning, subdivision and professional services at the December 12, 2017 CEDC meeting. The professional service fees were last amended in August 2004 via Ordinance 04-057. It is in the best interest of the Village to review and amend the development review fees from time to time. Staff will compare Homer Glen’s current fees with comparable communities and present suggested amendments to the current fees to make them more competitive, as well as to streamline the administrative process relating to collecting and refunding deposits.

HG-1727-S PI Tower Development LLC (Public Hearing):Consideration of a Special Use Permit for a Wireless Communication Facility (WCF), 150’ in height, in the A-1 Agricultural District for 17239 S. Parker Road.

HG-1726-V Mitch Mrowca (Old Business):Consideration of a request for: (1) a variance to permit an accessory structure in the required front yard of the subject property where accessory structures are not a permitted obstruction; (2) a variance to reduce the required front yard setback for an accessory structure located within the required front yard of a residential property from forty (40) feet to three (3) feet; and (3) a variance to increase the number of home occupations permitted on a single zoning lot from one (1) to two (2) for certain real property located at 14623 W. 143rd Street.

Case HG-1725-V Marsala Property (Public Hearing):Consideration of a variance to reduce the lot frontage from two hundred seventy (270) feet to zero (0) feet for certain real property with the PIN 16-05-23-300-043-0000. This parcel received a variance from the Village in 2005; however, it expired as the Marsalas did not apply for a building permit within one year following the approval. The variance is necessary since access to this parcel is only available from a private access easement fronting S. Parker Road.

Case HG-1727-S Insite, Inc. (Public Hearing):Consideration of a Special Use Permit for a new wireless communications facility one hundred fifty (150) feet in height at 17239 S. Parker Road. The applicant performed due diligence and was unable to find co-locations on existing towers or any public property. Verizon Wireless will be the anchor tenant with co-locations for three or more tenants.

The applicant requests any relief necessary to conduct W. M. Imports, Inc. and Diamond Glass Block, Inc. on the subject property.

Subdivision Code Update (Plan Commission Workshop):Consideration of Text Amendments to Chapter 138, Land Use, Code of the Village of Homer Glen, re-codifying and amending the requirements and standards regulating subdivisions and site developments. The Village consultant for this project, Ancel Glink, will be facilitating this workshop introducing the latest working draft with some code enhancements.

Sign Code Update:Planning staff is also reviewing best practices in sign regulations and our current sign regulations that establish limits on the size, height, number, location and design of signs, including restrictions on electronic message board signs. When the review is completed, the proposed changes and code enhancements will be presented to appropriate board committees. Case HG-1722-V Zuzanna Staszel (Public Hearing): Consideration of a request for approval of a variance to increase the maximum height for the proposed corner side yard fence in the R-5 Single-family Residential District from four (4) feet to six (6) feet [Chapter 220 (Zoning) of the Code of the Village of Homer Glen], for 15650 Badger Lane.

Case HG-1723-V Jarper Properties, LLC (Public Hearing): Consideration of certain variances to reduce the required side yard and rear yard setbacks for the proposed attached townhomes in the R-6A Attached Single-family Residential District [Attachment 1, Table 1B (Site and Structure Bulk Requirements for Residential Districts) of Chapter 220 (Zoning) of the Code of the Village of Homer Glen], for 14611, 14617 and 14623 Clover Lane.

Subdivision Code Update (Public Meeting): Consideration of Text Amendments to Chapter 138, Land Use, Code of the Village of Homer Glen, re-codifying and amending the requirements and standards regulating subdivisions and site developments.

Case HG-1603-S Gulf Gas Station (Public Hearing): Consideration of a request for (a) a Special Use Permit amending the Planned Unit Development in the C-2 Local Business District, and (b) Special Use Permits for an automobile service station and a minimart associated with the gas station for 7-Eleven property. The applicant would reuse the existing convenience store for a minimart and install fuel tanks, dispensers and a new canopy for fueling. The applicant is not seeking any drive-through facility, outdoor seating, liquor license, or changes to hours of operation typically sought as special uses.

Case HG-1720-S 14815 S. Bell Road (Public Hearing): Consideration of a request for a Special Use Permit for a Massage Establishment (Attachment 2, Table 2A of the Code of the Village of Homer Glen), for certain real property located at 14815 S. Bell Road, Homer Glen, Illinois. This new business would be Broadway Massage with one employee.

Case HG-1721-V Jarper Properties, LLC (Public Hearing):Consideration of a request for a Variance to reduce the required rear yard setback for the proposed single family home in the R-3 Single-family Residential District from forty (40) feet to thirty (30) feet [Table 1B (Site and Structure Bulk Requirements for Residential Districts) of Chapter 220 (Zoning) of the Code of the Village of Homer Glen], for Lot 54, Glenview Walk Estates, Homer Glen, Illinois.

Case HG-1719-A, Zoning Code Amendments (Public Hearing): Consideration of Text Amendments to Articles III, VIII, VIII, IX, X, and XII of Chapter 220, Zoning Code of the Village of Homer Glen, amending the requirements and standards regulating the planned unit developments (PUDs) and special use permits including definitions, procedural steps, and standards.

Case HG-1713-PS: Waterfall Place Commercial Center- Final Plat- Legacy Development Group has requested for approval of the Final Plat of Consolidation to allow them to excavate the detention ponds and start mass grading of the property.

Case HG-1718-S: Victorian Village PUD Amendment for Parking- Victorian Village is proposing to add 14 parking spaces, amending the PUD that was last amended and approved in 2012.

Case HG-1714-V: Janet and Richard Modelski have requested a variance to reduce the required corner side yard setback from 45 feet to 35 feet 8 inches in the C-1 Neighborhood Commercial District for the Richard J. Modell Funeral Home located at 12641 W. 143rd Street.

HG-1715-V:

Linda and John Handley have requested a variance to permit a five foot, 50% open fence in the corner side yard in lieu of the required four foot, 50% open fence in the corner side yard for certain real property located at 14001 W. Clifton Lane.

HG-1716-V: Roger Collins d.b.a. A1 Insurance and Financial Services LLC has requested a variance to permit a wall sign area of 23 square feet in lieu of the 15 square feet permitted for certain real property located at 15745 S. Bell Road.

HG-1717-PS: Bank of America has requested consideration of (1) a Plat of Consolidation and (2) Special Uses for (a) a Planned Unit Development in the C-2 Local Business District with certain zoning and sign variances, and (b) a drive-through facility associate with the bank for certain real property located at 14247 S. Bell Road.

Neighborhood Meeting for Gas N’ Wash (Case No. HG-1706-PS): The Village of Homer Glen will conduct a neighborhood informational meeting on Tuesday, May 23, 2017 at 7:00 p.m. on the application of Leonard McEnery for certain real property that is located at the northeast corner of 159th Street and South Gougar Road and known as PIN 16-05-17-300-013-0000. The purpose of the neighborhood meeting is to review and address the major issues brought up at the May 4th Plan Commission meeting regarding the following zoning requests: (1) a Preliminary and Final Plat Application; and (2) a Special Use for a Planned Unit Development in the C-3 General Business District. The petitioner is also requesting the Special Use Permit for (a) mini-mart associated with the gas station, (b) car wash, (c) associated drive-through, (d) packaged liquor sales, (e) outdoor sales and storage, and (f) hours of operation on the subject property.

Case HG-1711-V: Michelle Reiter has requested (1) a variance to reduce the required side yard setback for the proposed garage in the R-2 Single-family Residential District from twenty (20) feet to twelve (12) feet, and (2) a variance to allow more than three car bays in width facing a public right-of-way for certain real property located at 14528 S. Hawthorne Court N.

Bank of America Workshop: Bank of America (BOA) will be relocated as a result of the right-of-taking by Will County for roadway improvements on Bell Road and 143rd Street. Representatives of BOA will present their concept plans proposing to demolish the existing structure and parking lot to construct a 3,896 square-foot financial building with a drive-through, parking, and underground utilities.

Case HG-1709-S: RDK Ventures d.b.a. Circle K has requested a Special Use Permit for hours of operation beyond the normal 6:00 a.m. to 11:00 p.m. business hours (for a 24-hour business) for 12819 W. 143rd Street.

Case HG-1710-S: Chipotle Mexican Grill Inc d.b.a. Chipotle Mexican Grill #2658 has requested a Special Use Permit for the sale of alcoholic beverages as an ancillary use to a permitted restaurant for their location at 14114 S. Bell Road.

The petitioner is also requesting a Special Use Permit for (a) mini-mart associate with a gas station, (b) car wash, (c) associated drive-through, (d) packaged liquor sales, (e) outdoor sales and storage, and (f) hours of operation. The property is located at the northeast corner of 159th Street and S. Gougar Road.

Case HG-1707-V: Joseph and Melissa Warren have requested a variance to reduce the required rear yard setback for a swimming pool in the R-2 Single-family Residential District from twenty (20) feet to ten (10) feet. The property is located at 17208 Oak Meadow Court.

HG-1708-S: Best Pizza in Homer Inc. d.b.a. Kenootz Pizza has requested a Special Use Permit for the sale of alcoholic beverages as an ancillary use to a permitted restaurant. The property is located at 15755 S. Bell Road.

Case HG-1705-MS: Scott, Jeremy, and Daniel Bengston have requested (1) a Map Amendment (rezoning) from the R-4 Single-family Residential District to the A-1 Agricultural District and (2) a Special Use for a Planned Development in the A-1 Agricultural District in accordance with Chapter 220 (Zoning), Article 9 (Planned Development) of the Code of the Village of Homer Glen. They are also requesting any relief necessary to conduct the Bengston’s Pumpkin Fest on the subject properties.

PLEASE NOTE: A Neighborhood and Informational Meeting for Bengtson’s Zoning Requests will take place on March 30, 2017 at 7 PM in the Village Board Room.

Case HG-1704-V: Martin Ozinga III has requested a variance for a proposed driveway from the minimum required five (5) feet to zero (0) feet from the property line for the subject property located at 12225 W. 179th Street.

Case HG-1634-S: Circle K d.b.a. RDK Ventures is requesting four (4) Special Use Permits for 12819 W. 143rd Street. They are requesing a SUP for an automobile service station, a Mini Mart (associated with a gas station), a Car Wash, and the sale of packaged liquor. The property is zoned C-2 Local Business.

Case HG-1702-M: The Homer Township Public Library, 14320 W. 151st Street, has requested a Zoning Map Amendment (rezoning) from the C-1 Neighborhood Commercial zoning district to the P-1 Governmental Buildings and Public Schools zoning district. This zoning district was created to serve the special needs for governmental buildings and public schools.

Case HG-1703-M: The Village of Homer Glen, 14240 W. 151st Street, has requested a Zoning Map Amendment (rezoning) from the C-6 Commercial Recreational zoning district to the P-1 Governmental Buildings and Public Schools zoning district.

Case HG-1701-V: Hector Rivera, owner of 13728 S. Bell Road, has requested a variance to permit a structure used in connection with a commercial stable to be located 250 feet from any zoned residential district in lieu of the 350 feet required and for the structure used in connection with the commercial stable be 0 feet from a property line in lieu of the required 100 feet. (To be continued to March 2, 2017 meeting at the request of the applicant).
Case HG-1635-Phone: Aqua Pools has requested a Plat of Consolidation for their property located at 13445 W. 159th Street.

Case HG-1632-MPV: Jozef Reczek, owner of 14438 Dixon Lane, has requested approval of a plat of consolidation, rezoning of one of the parcels from R-2A to A-2 to match the other two parcels and the zoning for the area, and a variance to reflect the existing lot width, which is less than the 300 feet required. (To be continued to February 16, 2017 meeting at the request of the applicant.)

Case HG-1633-V: Mike Jessup, owner of 15517 W. 151st Street, has requested three variances. One for lot area and one for lot width would make the lot buildable. He is also seeking a variance to allow a side yard setback of 0 feet instead of the required 100 feet for an agricultural structure to build a pole barn on the property.

We are starting the New Year off with a staff-presented training on the two Illinois "Sunshine Laws" - the Open Meetings Act (OMA) and the Freedom of Information Act (FOIA). OMA training is required for all members of public bodies. The intent is to provide members of the commission with a good working knowledge of both Acts provisions so they are properly informed and educated about conducting the public’s business.
